Foreign Passenger Detained for Smoking on an Airplane

On August 16, as reported by People’s Rule of Law, the Airport Public Security Bureau of the Guizhou Provincial Public Security Department recently handled a case involving a foreign passenger who was caught smoking on an airplane, causing a disruption to public order. This incident is noted as the first of its kind involving a foreign passenger in Guizhou.

The incident occurred on August 9, during flight CA1463 from Beijing to Guiyang. The crew reported to the Airport Public Security Bureau that a foreign passenger had been smoking an e-cigarette in the aircraft’s restroom, which activated the smoke alarm. In response to the report, officers promptly proceeded to the aircraft’s parking position to address the situation. The passenger was legally summoned for questioning and an investigation was carried out.

The investigation determined that the passenger’s actions violated Article 23, Paragraph 1, Item (3) of the “Law of the People’s Republic of China on Penalties for Administration of Public Security,” constituting a public order violation on public transportation. Consequently, the police imposed a five-day administrative detention on the individual. In accordance with protocols for handling cases involving foreign nationals, the relevant departments were notified of the incident. The passenger has been taken to Guiyang Administrative Detention Center to serve the detention.
