A non-Chinese citizen has received a criminal sentence in Yunnan Province after shelling out 260,000 yuan (approximately 36,000 US dollars) to fraudulently acquire a Chinese resident identity card.
Court documents released by the Lancang County People’s Procuratorate show that the suspect, surnamed Yan, acted out of a desire to access various welfare benefits exclusive to Chinese citizens. Back in 2023, Yan transferred the substantial sum via underground illegal channels and secured a legitimate-looking Chinese ID card by fraudulently utilizing another individual’s personal identity details.
Following the illegal acquisition of the identity document, Yan exploited the fake ID to process multiple official certifications and claim medical expense reimbursements reserved for domestic residents.
During further investigations, law enforcement authorities uncovered additional violations committed by Yan: the foreign national had repeatedly crossed China’s national border illegally using counterfeit entry and exit documents obtained through fraudulent means.
Yan was finally held criminally liable on two counts: trading personal identification documents and illegal border crossing. The court handed down a criminal penalty alongside a fine for the offenses. All other accomplices implicated in the entire case have also been pursued for corresponding legal accountability.
Relevant Provisions of Chinese Criminal Law
Per Article 280 of the Criminal Law of the People’s Republic of China, any act of forging, tampering with, purchasing or trading legally effective identity credentials — covering resident identity cards, passports and other official identification documents — qualifies as a criminal offense.
Meanwhile, Article 322 of the same criminal code stipulates that severe instances of illegal national border crossing shall incur corresponding criminal sanctions.
The local procuratorate issued a public reminder that any conduct involving purchasing Chinese identity documents, impersonating others by using their identity information, or evading border inspection with forged credentials will lead to severe legal repercussions.
The case delivers a clear warning to all foreign nationals residing in China: no illegal loopholes or shortcuts exist to obtain Chinese identity documents or citizenship-linked benefits through identity trading and fraudulent practices.
