Foreign National Sustains Serious Injuries in Fight with Others

In the early hours of November 2024, an unprovoked street fight erupted among several Moroccan nationals in Shanghai, disrupting the quiet of the late-autumn city. The confrontation turned brutal when one man, identified as ​K, was knocked to the ground and viciously attacked by the group. He sustained severe facial injuries, including swelling and heavy bleeding, before managing to report the incident to authorities—though he left the scene before police arrived due to the pain.

​Background of the Dispute​

Police investigations revealed that the violence stemmed from a prior argument between ​K​ and ​Z​ at an entertainment venue called ​INS Paradise. The conflict began over a minor issue but escalated when ​Z​ introduced ​K’s girlfriend, W, to others in the bar, angering ​K. A verbal argument quickly turned physical, with ​K​ assaulting ​Z, and their friend ​N​ joining in—reportedly motivated by past grievances with ​Z.

​Legal Proceedings​

Authorities launched a ​criminal investigation​ into charges of ​intentional assault​ against ​K​ and ​N. A forensic assessment confirmed that ​Z​ suffered a ​nasal fracture, classified as a ​minor injury​ under Chinese law. The case was later forwarded to the ​prosecutor’s office.

​Defense and Outcome​

​N​ received legal representation from ​Huang Zhaowei​ of the ​Shanghai Jinmao Law Firm. After reviewing the evidence, the defense argued that there was ​no direct proof​ (such as video or eyewitness testimony) that ​N​ had kicked ​Z​ in the face—the alleged cause of the nasal fracture. Instead, the injury likely resulted from other factors during the brawl.

Prosecutors ultimately ​accepted the defense’s arguments​ and ​dropped charges against N. However, ​K​ faced prosecution for his role in the assault.

  • ​Under Chinese law, intentional harm can lead to ​imprisonment:
    • ​Up to 3 years​ for minor injuries.
    • ​Up to 10 years (or more)​​ for severe injuries or fatalities.
  • While the fight was initially driven by personal disputes, the involvement of ​multiple foreign nationals​ and ​alcohol​ exacerbated the situation, disrupting public order.
  • ​Huang Zhaowei​ stressed the importance of ​respecting Chinese laws, particularly for foreigners.
  • Although ​N​ was not criminally charged, ​administrative penalties​ (including ​deportation) could still be imposed under China’s ​Public Security Administration Punishments Law.

This incident underscores the ​complexities of handling legal disputes involving foreign nationals​ in China. It serves as a reminder that ​understanding local laws is crucial, even in seemingly minor altercations, to avoid severe consequences.
