China submitted a second draft amendment to the Prison Lawto the Standing Committee of the 14th National People’s Congress (NPC) on Monday for further review, China Newsreported. The revised version includes new provisions on sentencing and managing foreign national inmates, ensuring their legal rights and fair treatment.
Key updates include:
- Foreign Inmates: Prisons must uphold their lawful rights, with visitation rules following state regulations. Transfers will comply with international criminal judicial assistance laws.
- Police Conduct: Stricter rules address misuse of equipment/weapons and leaks of sensitive information. Accountability for negligence will consider factors like intent and consequences.
- Rehabilitation: Pre-release education will help inmates prepare for life after parole or sentence completion.
- Juvenile Records: Criminal records of minors will be sealed.
The NPC Standing Committee first reviewed the draft in April. China’s current Prison Law, enacted in 1994, is being updated to address modern challenges, enhance security, protect inmates’ rights, and improve rehabilitation, per Xinhua.
